This document delineates the responsibilities and liabilities in the purchase of all stock from the website www.dunndunn.hk under the management of Dunn Dunn Wine Limited as well as stock from professional brokers. All customers are hereinafter referred to as “Purchaser”, and the sales persons trading as Dunn Dunn Wine Limited, hereinafter referred to as “the Stock Collecting Agent”.

All customers are hereinafter referred to as “Purchaser”, and the sales persons trading as Dunn Dunn Wine Limited, hereinafter referred to as “the Stock Collecting Agent”. Whereas, the Stock Collecting Agent agrees to effect delivering the wines listed on the relevant invoice based on the prices from the website www.dunndunn.hk, hereinafter referred to as “the Stock” under the terms and conditions set forth below; Whereas, the Purchaser agrees to accept under the terms and conditions set forth below. These Terms and Conditions apply as from July 2014.

The Company shall make every effort to ensure that prices, details and sizes of products on this website are up to date. Prices are subject to change without prior notice and all orders are subject to Company’s acceptance at its sole discretion and stock availability.

The Company shall make every effort to ensure products displayed on the website are in stock. If from time to time products become out of stock, the Company reserves the right offer alternative substitute products to the Customer of similar value and style.

  • You are required to register before placing any order through this website. During the registration:
  • You must provide us with accurate, complete and up to date registration information;
  • You must safeguard your username and password;
  • You authorise us to assume that any person using the site with your username and password is either you or is authorised to act for you;

The Stock Collecting Agent has the absolute discretion to refuse registration of a potential customer and to terminate the registration of any customer for any reason whatsoever.

You must inform us immediately of any changes to the information that you provided when registering an order so that we can communicate with you effectively.

Prices of the Stock from the Stock Collecting Agent, calculated in Hong Kong Dollars, are set out in any brochure, price list or any other literatures (emails and other digital form of communication included) collected from or based on the website www.dunndunn.hk operated by the Stock Collecting Agent are dependent entirely on the overseas or local suppliers, which do not include applicable duties on alcoholic beverages and delivery charges.

All prices are subject to change and should be checked with the Stock Delivery Agent at the point of ordering. On acceptance of the order the Stock Collecting Agent will confirm the price payable.

Payments from the Purchaser shall be made direct to the Stock Collecting Agent who accepts them on behalf of the suppliers and brokers. 

The Stock Collecting Agent reserves the right to charge interest at the annual rate of 3% above the prices of the Goods and such interest will accrue on a daily basis from the date on which payment become overdue up to the date on which the Stock Delivery Agent receives the full outstanding amount together with accrued interest.

Purchaser is to make payments direct the brokers and suppliers should the Stock Collecting Agent be of the opinion that, for the purpose of rendering good service or convenience to Purchaser, the brokers and suppliers are in a better position to receive them.

Regional deliveries to Hong Kong shall be arranged within 6 months by ship, or by any means to be negotiated. Any subsequent requirement will be charged according to current shipment and service rate. The associated, local Delivery charge and the duty on alcoholic beverages shall be settled by the Purchaser to the Stock Collecting Agent in full upon the arrival of the Goods.

Deliveries for current stock in Hong Kong shall be made within two work days by courier.

The Stock Collecting Agent will pay due diligence to ensure authenticity and provenance and the stock collected and reflect the condition of the stock collected professionally.

The Stock Collecting Agent has the right to dispose of the Goods in the event of

  • Delivery not pick-up by the Purchaser within 3 months upon arrival of the Goods in Hong Kong.
  • The Purchaser refusing to take delivery of the Goods.
  • No delivery due to un-notified of the Purchaser’s change of address.

All Customers are requested to examine the goods immediately upon collection or delivery for any deficiencies and/or damages. Claims (if any) must be lodged at the time of delivery, otherwise any breakages or shortfall shall be deemed to have occurred thereafter.

In the event that the Purchaser fails to fulfill any payment obligation 60 days after payment is due under this Agreement, the Company reserves the right to sell the Goods and deduct from the selling price of the Goods all outgoing expenses in the sale of the Goods to make up for the shortfall of the Purchaser’s outstanding payment obligation. In the event that the selling price after deduction of all outgoing expenses in the sale of the Goods is insufficient to offset the Purchaser’s outstanding payment obligation, the outstanding balance will remain payable by the Purchaser and will continue to accrue interest at the rate set out in these Terms and Conditions.

  • All orders for wines shall be deemed to be an offer by the Purchaser to purchase the wines pursuant to these Terms and Conditions.
  • Receipt of an invoice from the Company will constitute acceptance of the Purchaser’s order pursuant to these Terms and Conditions.
  • Any cancellation of order must be made in writing within 1 day of the acceptance of the order by the Stock Collecting Agent. The cancellation shall be subject to the Purchaser indemnifying the Stock Collecting Agent in full against all loss, damages, charges and expenses incurred by the Stock Collecting Agent as a result of the cancellation.

The Stock Collecting Agent shall not in any circumstances be liable for any indirect or consequential loss or damage arising from wastage, spoilage or the deterioration of any of the Goods, the loss of market for the Goods, decline in the value of any of the Goods or for the damages arising from or attributable to any cause. The Stock Collecting Agent shall not in any circumstances be liable or obliged to repurchase the Goods or to affect any future sale of the Goods.

All warranties and conditions either implied by statue or otherwise are excluded from these Terms and Conditions. Provided that nothing shall restrict or exclude liability for death or personal injury caused by the negligence of the Stock Collecting Agent or affect the Purchaser’s statutory rights as a consumer.

In the event of war invasion act of foreign enemy hostilities (whether war has been declared or not), civil war rebellion revolution, insurrection or military or usurped power, the Stock Collecting Agent shall be relieved of liabilities incurred under this Agreement wherever and to the extent to which the fulfillment of such obligations is prevented, frustrated or impeded as a consequence of any such event or by any statute, rules, regulations, orders or requisitions issued by any government department, council or other duly constituted authority or from strikes, lockout, breakdown of plant or any other causes (whether or not of a like nature) beyond the Company’s control.

The Stock Collecting Agent may license or sub-contract all or any part of its rights and obligations under this Agreement without the consent of the Purchaser.

This Agreement and these terms of sale shall be construed in accordance with and governed in all respects by the laws of Hong Kong and the parties hereto agree to submit, subject to recourse to arbitration as herein provided, to the non-exclusive jurisdiction of the courts of Hong Kong.
